When you have a unique product, or business name, then it is important that you protect it from infringement through trademark registration. By so doing, you protect your marketing strategy, position, and commercial advantage from being misused by unscrupulous people. Once you do so, the law considers you as the legal owner of the trade or brand name, and any other person who uses it will be infringing on the law.

The first advantage trademark registration is that of giving you the lasting right to use the trademark in any way that you propose. It ensures that no other person can use a similar, or confusing, trademark to sell their products. Anybody selling overlapping products, or services, is doing so against the law. If you fail to register you trademark on time, an unscrupulous party may do so before you, and thereby turn the tables against you. It is prudent that you register your trademark as soon as possible.

Once you submit a trademark application, it will be checked by the registrar, to ensure that it is truly unique. It must be different from other earlier registered trademarks. It should not be descriptive of your products and services, or generic, and should therefore be distinct. Once the registrar determines that these conditions have been met, and there are no conflicts, then you will be given the right to register the trademark, logos, and any slogans that you may come up with.

One should not confuse registering a trademark, with registering a domain. It has been noted in the past, that some domains, bearing names of popular trademarks, have been registered by domain-name squatters. The original brands have had to pay a steep price when buying these domains back. Consider all aspects of your brand, and have them secured legally, by starting off with trademark registration. Once this is done, then you can proceed to register your domain name.

Search the Internet for reputable firms that can help you register your trademark. Look through review sites and see what others have to say about the services available. Select a few, and pay them a visit for a face-to-face interview. Then finally register your trademark. Your customers will always identify your products by your trademark, and you must protect it against misuse by third parties. This way, you protect your market, and thereby the profitability of your company, ensuring that you get justified compensation for your hard work.
