Leave of absence allows workers to stop going to work for certain periods without losing their jobs. For instance, women are allowed to go on maternity leave during, before and after delivery. Some leave options are protected by the Family and Medical Leave (FMLA) Act while others are arrangements between employers and their employees. It’s essential to understand the employee leave process and the various situations in which employees would need to use it.
Employee Leave Process
Various steps are important to follow when paid or unpaid employee leave is taken, so that all involved understand the situation and their respective rights and responsibilities. Such essential information to discuss includes:
- Leave Request – The first step in establishing leave is to ask the employer. Companies have different procedures for requesting a leave of absence. Employees should find out about the procedures from their respective human resources departments. In most cases, employees must write a letter to human resources requesting a leave of absence. The letter would be followed by a meeting with the HR department, supervisor or manager to determine the validity of the request, which will then be denied or accepted.
- Important Details – A leave of absence can be as short as a few days or as long as several month. The length of the leave is determined by its nature. The main reason why employees request a formal leave is to have enough time away from work without losing their jobs. A paid leave allows employees to continue receiving their full pay including benefits such as health insurance and retirement savings.
- Pay – The FMLA does not state that employees must be paid. Many employers do not offer a paid leave of absence. However, employees can take advantage of other benefits including short-term disability while on unpaid leave. The employers who offer paid leave allow employees to receive full pay and benefits while on leave.
Types of Paid Leave
Various situations may warrant the need to take a paid leave of absence. Depending upon employer rules, these may include:
- Medical Leave – Employees can take this type of leave based on their medical history or that of their family members. For instance, if an employee’s family member is hurt in an accident, the employee can take a leave to go take care of the family member. However, only certain family members qualify. These are sons, daughters, spouses and parents but not siblings. Personal medical emergencies that warrant a paid leave require employees to stay in hospitals or other approved facilities. Failure to do this will result in the employee being rendered incapable of performing his/her job.
- Military Leave – Paid leave is also offered to members of the armed forces and their families. This type of leave applies to employees who have been called to military duty and to workers who must care for sick or injured service personnel.
- Domestic Violence Leave – The rules regarding paid leave for domestic violence vary with each state. In Colorado, for example, an employee is given 3 leave days if he/she is a victim of domestic violence. Such violence includes sexual assault, stalking and abuse. The purpose of this type of leave is for employees to seek professional assistance, including counseling.
Tracking employee time off, including period of leave and vacation, can be a challenging endeavor especially for managers in charge of large teams. Employee leave management software allows employers to track time off and administer FMLA and paid leave throughout the year. Employers lose a lot of money each year through lost hours. Employee leave management software helps employers streamline requests and keep their businesses working at optimum levels to avoid losses.
