Housing discrimination cases are filed by millions per year. Most do not understand protections of Fair Housing Act-Call our civil rights attorney
|
Housing discrimination is unfortunately a truly pervasive problem all across the United States. It is severely under reported which means not enough people are coming forward to admit that they were discriminated against. According to the Fair Housing Act, you are not allowed to be discriminated when it comes to housing on the basis of disability, familial status, sex, religion, national origin, color or race. If you were discriminated against for any of these reasons and denied housing, you have the right to take the liable party to court.
Housing discrimination does not necessarily mean having the door shut in your face, or even a racist remark directed toward you. Unfortunately, many people are completely unaware of the fact that they have been victimized by the housing discrimination problem. HUD performed a study in 2002 that suggested that many homebuyers and renters were completely unaware of what activities are considered to be illegal according to the Fair Housing Act. If you believe that your rights have been violated or that you have been treated in a manner considered illegal by the Fair Housing Act, then the first course of action for you is to contact a civil rights attorney. Your civil rights lawyer will do a thorough review of the evidence surrounding your case and advise you as to whether or not your claim has merit to pursue further legal action.
Lending and housing discrimination takes place when an individual attempts to buy or rent a home, and can also take place when they apply for a mortgage or homeowner’s insurance. 35 years after the Fair Housing Act was enacted, millions of housing discrimination complaints are filed every year through various non for profit fair housing agencies, the Department of Justice, the Department of Housing and Urban Development and local as well as state agencies.
Here is a summary of what actions are prohibited in the Fair Housing Act although this list is not conclusive. In regards to the rental and sale of housing, no one can legally take any of these actions based on color, race, religion, national origin, familial status, sex or handicap:
Setting different conditions, terms or privileges for the rental or sale of housing
Denying falsely that a dwelling is available for sale, rental or inspection
Refusal to sell or rent housing
Deny dwelling
Refusal to even negotiate for housing
Making housing unavailable
Providing different housing facilities and services
Persuading an owner to rent or sell for profit
Denying a person access to membership to a service or facility that is related to the rental or sale of housing
If you believe you are the victim of housing discrimination, then call a civil rights attorney to protect your rights and prevent further abuses of others. Taking the liable parties to court may be the best way to make them own up to their actions, and you may receive a settlement or reconsideration for housing.
