Getting an admission into school is a Herculean task. What's worse is once a parent struggles to get the kid admitted; the kid refuses to go to school. In ordinary circumstances, a parent would be forced to send the child to school only because it's easier to send the child to school, than to get a refund. Surprisingly, there doesn't seem to be any law which that can assist a Parent in India regarding a refund of fees on cancellation of admission. In a reply post to an anxious parents request for information on refund of fees, another parent asked what was to be done if the school was still under construction, could they deduct the term fee, etc? These have been questions that have troubled Indian parents quite often. Infact, one parent even went to the extent of asking whether she should approach the consumer court for justice on the issue.

On the subject of fee refunds, another parent questioned whether a school could hold on to any amount towards cancellation of admission even before the academic year could commence. A forum by the consumer court posted on the issue read: "Schools or other educational institutions cannot be allowed to behave like business establishments that work with a profit motive. Also, there is no justification in retaining the fee paid by a student, who decides not to pursue his/her studies in the said school/institution and in the interest of education, must be fully returned with a due deduction in the processing fee and administrative charges.
Even the AICTE stated, that if a seat in a course falls vacant, due to a student not joining, by the last date of admission, the institution must return the fee collected from the parent with proportionate deductions of monthly fee and hostel fee, if applicable.
