Do you have an innovative new product idea and are wondering how to go about filing for patent? Before concerning yourself with filing patent application, make sure your invention meets the application criteria. In order to be eligible to request a filing patent application, your invention must be a new physical object that you created. You must also be able to describe the building process in detail when filing for patent so manufacturers can re-create it.

Search for Existing Patents First

Even if your new product seems incredibly creative to you, there is always the possibility that someone else has already created it. You can go online to locate a list of existing patents to scan for an idea identical or very similar to yours. Another option is to hire a patent specialist or attorney to research existing patents on your behalf.

Choose Your Patent Type

There are three possible types of patents. These are plant, design and utility. The patent for plants refers to the creation or discovery of new species of plants or a hybrid. The design patent is for original designs submitted for the manufacturing process and utility designs are patents that recognize new machines or processes. Of the three patent types, the utility patent is the one most commonly requested.

Consider a Provisional Patent

If this is your first attempt at obtaining a patent, you may wish to opt for the provisional patent first. It gives you one full year of patent protection so you have time to devote to completing your application for a full patent. It costs far less to file for a provisional patent that a full one.

Writing Your Patent

The first part of the patent application you must complete, after filling in your name and other identifying information, is the patent specifications. This refers to how the invention will work and what specific steps must be taken in order for it to function properly. You can also include drawing diagrams in this section if it will make the specifications clearer to someone who is unfamiliar with your patent idea. When writing you descriptions, try to do so in broader terms so it is more difficult for others to copy your patent specifications.

Filing Your Patent

Once you have completed the extensive paperwork required, you can file it with the patent office and await a reply notifying you of acceptance or rejection.
