Employment discrimination can come in a wide variety of different forms, including discrimination that is based on sex, race, religion, physical disability, national origin and even age on the behalf of an employer. Employment discrimination laws were put in place to prevent such discrimination from occurring and an increasing body of laws also seeks to stop discrimination by an employer that may be based on a person’s sexual orientation. The United Stated Constitution contains a very specific guarantee that each person has equal protection under the law. The 14th Amendment very plainly prohibits states from violating a person’s right to equal protection and due process. In the context of employment, this right limits the power of the state as well as federal government to discriminate by treating a current employee, a former employee, or applicants for a job unequally due to membership in a specific group which may include race or sex for example. There is an increasing body of state and federal statutes aimed at constraining discrimination in the private sector as well.
The following are a few very specific federal laws that prohibit employment discrimination. The Equal Pay Act of 1963 protecting women and men who are performing equal work for the same employer from wage discrimination based on sex, the Civil Rights Act of 1991 which provides monetary damages in intentional discrimination cases in the employment arena, Title VII in the Civil Rights Act of 1964 prohibiting discrimination in employment based on color, race, sex, religion or national origin, Age Discrimination in Employment Act of 1967 protecting persons who are over 40 years of age, Title I and V of the Americans with Disabilities Act of 1990 prohibiting discrimination in employment against a qualified person with disabilities in both the private sector as well as in local and state governments, etc.
The EEOC (U.S. Equal Employment Opportunity Commission) is in charge of enforcing these laws.
Discriminatory practices in the workplace can include a bias in hiring, in promotion, in the assignment of jobs, in termination, retaliation, compensation and a wide variety of different types of harassment as well.
