Desk study will give a structured and systematic approach to minimize the risk regarding flooding while building projects. It helps to assess risks effectively, avoid it as far as possible and when not able to avoid, then giving adequate advice and warning to clients.
During desk study for a risk assessment there involves mainly two considerations. One is that regarding the vulnerability of the proposed structre for flooding and another is whether the new structure could increase the risks. This otherwise relay on various risks during construction (risks of temporary work, and that may be responsible for the professionals) and the risk of mere presence or operation of permanent works.
Any major project will be including a desk study will almost all details. It includes investigation of the history of the flooding of site. A desk study should highlight the risk factors at a place to beaffixed by field investigations such as soil surveys and topographic surveys. If the excavation of the site are given by client or on behalf of other consultants, general professional, you can expect to have them but not relieved of the duty to review their suitability. Contractual considerations
The point first and most clearly visible is that the Council must ensure that a written contract, among other things, clearly describes the scope of services it has agreed upon to provide. Finanacial obligation arising from such services may be limited or excluded in some cases. Contractual provisions that the consultant will be in itself (as well as in relation to flood risk and, more generally) are exclusion of liability for the lack of the sub-consultants appointed with client's consent or excluding indebtness for indirect losses etc.
Conclusion
Flood risk, like many other hazards in the construction can be managed if recognized and properly studies . Liability for those risks that cannot be avoided can be mitigated by proper use of exclusions and limitations. A desk study does not contain a complete description , or the law, and does not constitute any legal advice. This is only meant to highlight problems that may be of interest, a legal expert opinion may be requested if necessary.
